Rebel Creamery, a Utah-based low-carb ice cream maker, filed for Chapter 11 bankruptcy on August 14 after a federal judge ordered the company to pay nearly $24 million in a trade-dress dispute with rival Van Leeuwen Ice Cream. The company listed $13.78 million in assets and $23.85 million in liabilities in its bankruptcy filing, according to court documents.

The legal battle arose from Rebel Creamery’s packaging design, which features solid-colored pint containers with minimalist styling and prominent black cursive lettering. Rebel’s founders claimed they created the logo and packaging themselves in Adobe Illustrator in late 2017 and did not retain drafts or initial design records. However, U.S. District Judge Eric Komitee ruled on July 16 that Rebel had intentionally infringed and diluted Van Leeuwen’s trade dress, describing the infringement as deliberate.
